Terms of Service

These Terms govern the use of Vribe. They are written so you can verify everything they claim: they describe mechanisms that exist in the product, not intentions. They are split into four blocks — what applies to everyone, what binds only travelers, what binds only hosts, and the general provisions. Read the block that applies to you; the others tell you how the other side is expected to behave.
Block I — Applies to everyone
Rules that bind travelers and hosts alike.
1. Acceptance of terms
By accessing and using the Vribe platform (vribe.app), including its mobile apps and related services, you accept these Terms of Service and our Privacy Policy. If you do not agree, please do not use our services.
1.1 Who can accept
Only a person with legal capacity to be bound may accept these Terms. If you accept on behalf of a company, you represent that you have authority to bind it, and "you" includes that company. Accounts cannot be shared: every person using the Platform needs their own.
1.2 How acceptance happens
Acceptance occurs when you create an account and, additionally, every time you use the Platform. Nothing needs to be signed: continued use amounts to acceptance. Booking, listing a vehicle or accepting a rental contract are acts that presuppose these Terms already bind you.
1.3 Which version binds you
The version published on this page at the time of each act binds you. The last-updated date appears above. When a change is material we notify you before it takes effect, as set out in the Modifications section.
2. Definitions
These terms carry the same meaning throughout Vribe's legal corpus — these Terms and the documents they incorporate by reference:
- Platform: the vribe.app site, the mobile apps and related services.
- Vribe, we: Vribe, Inc., a company incorporated in Delaware, United States, operator of the Platform.
- User: any person with an account on the Platform, whether host, traveler or both.
- Host: the user who lists a vehicle they own for rent.
- Traveler: the user who books a vehicle listed by a host.
- Listing: a vehicle's publication, with its photos, price, availability and conditions.
- Booking: the agreement between host and traveler over a vehicle and a date range, managed by the Platform.
- Rental contract: the per-trip contract entered into by host and traveler between themselves. Vribe is not a party.
- Rental: the price of the hire, excluding the security deposit and the delivery fee.
- Security deposit: the refundable hold that answers for damage, fines or missing fuel.
- Service fee: what Vribe charges for operating the Platform, deducted from what the host receives.
- Payout: the payment the Platform transfers to the host once the trip has concluded.
- Inspection: the photographic record of handover and return, sealed so later alteration is detectable.
- Verified policy: the vehicle's insurance policy whose validity and details were checked and which enables bookings.
3. Service description
Vribe is a P2P (peer-to-peer) marketplace platform that connects vehicle owners ("Hosts") with people who want to rent them ("Travelers") in Guatemala and Central America. Vribe does not own the listed vehicles and acts solely as a technology intermediary.
3.1 What the Platform does
The Platform publishes vehicle listings, lets you search and book them, processes payments, holds the security deposit, records handover and return inspections, channels communication between the parties, runs the dispute process and pays out the host. All of that is intermediation.
3.2 What the Platform does not do
Vribe does not rent out vehicles, does not guarantee their mechanical condition or actual availability, does not supervise driving, does not provide roadside assistance and does not insure anyone. Nor does it guarantee that you will find a vehicle, that your request will be accepted, or another user's conduct.
4. Vribe's role and the independence of the parties
Vribe connects hosts with travelers: it verifies identities and licenses, requires a valid insurance policy before a vehicle is published, processes payments, documents the vehicle's condition with inspections at the start and end of each booking, and mediates disputes between the parties. Vribe is NOT a car rental company, is NOT an insurer or insurance intermediary, and is NOT a party to the rental agreement, which is entered into directly between the host and the traveler. Hosts are independent operators: they are not employees, agents or representatives of Vribe, they set their own prices and conditions, and they are responsible for the condition, documentation and legality of the vehicle they publish.
4.1 Vribe is not a party to the rental
The rental contract is entered into directly between host and traveler. Vribe facilitates it, keeps its record and offers a dispute process, but does not sign it and does not assume either party's obligations. Claims about the vehicle's condition, its use or performance of the trip go to the counterparty.
4.2 Host independence
The host operates on their own account. They decide which vehicle to list, at what price, on which dates, with what handover hours, under which cancellation policy, and whether to accept instant booking or require approval of each request. Vribe does not set those conditions or instruct them how to perform.
4.3 Vribe as collection agent
Vribe collects booking payments as the host's collection agent: it receives the traveler's money in order to collect it, hold it and pay it out to the host. The practical consequence is that paying Vribe discharges the traveler's obligation to the host for the amount paid. That mandate covers collection and payout only: it does not make Vribe a party to the rental contract, nor the host's representative for any other obligation — not for handing over the vehicle, not for answering for its condition, not for assuming the host's commitments. The detail is in the Payment Terms.
4.4 No employment or agency relationship
Nothing in these Terms creates an employment, partnership or franchise relationship between Vribe and a user, nor any agency beyond the collection mandate described above. No user may bind Vribe towards third parties or hold themselves out as its representative.
5. Vehicles with chauffeur
Some hosts offer their vehicle with a person who drives it. In that case you do not rent the vehicle: you book a transport service the host provides with their own chauffeur. That service is governed by the "Rental with Chauffeur" Conditions —which the passenger accepts when paying for each trip and the host when offering the vehicle in that mode— and by the country supplement; these Terms apply to everything else. The host chooses, directs and pays the chauffeur, and is liable for the driving.
6. Documents that form part of these Terms
These Terms incorporate by reference the following documents from the Legal Center. Each describes the mechanics of its area in detail and binds you just as this document does; if something here and there appears to conflict, the specific document prevails.
7. Eligibility
Using Vribe carries minimum requirements, and they are checked before you can book or list — not after something goes wrong. You need to:
- Be at least 21 years old
- Hold a valid driver's license issued in Guatemala, Central America or your country of residence
- Provide a valid ID document (DPI, passport or driver's license)
- Have an active credit or debit card for payments
- Have no history of fraud or misuse of the platform
7.1 Registration and account
Using the Platform requires an account with accurate details. You are responsible for your credentials and for everything that happens under your account; tell us immediately if you suspect unauthorized access. One person may not hold several accounts, nor operate under someone else's.
7.2 Identity verification and consent
Before renting or listing, identity and driver's licence must be verified. By submitting those documents you authorize Vribe and its providers to examine them, cross-check them against your profile information and retain them as evidence as set out in the verification document. Vribe may refuse or revoke a verification, and an expired licence blocks both booking and listing.
7.3 Accuracy of information
You must keep your details current while you use the Platform. Providing false information, using someone else's documents or altering your own are grounds for immediate suspension, and may carry liability towards the affected user.
8. Ranking and visibility of results
When you search, the Platform filters by what you asked for — city, category, maximum price, transmission, features, home delivery, instant booking, airport radius — and returns up to fifty vehicles. You choose the order among these criteria:
- Rating: best average first. This is the default order.
- Price ascending: from the lowest daily rate to the highest.
- Price descending: from the highest to the lowest.
- Trips: vehicles with more completed trips first.
- Proximity: those closest to your location, when you share it. If you do not, it falls back to rating order.
8.1 We do not sell placement
No host can pay to appear higher, and there is no advertising, sponsorship or purchased prominence within the results. The order is computed from the criteria above alone. What we do protect is the host's address: coordinates are blurred on the map, and the exact location is only resolved server-side to compute distances.
9. Use of artificial intelligence
Vribe uses artificial-intelligence models in several parts of the product. We would rather state it here, with detail on where and under what limits, than bury it in a footnote.
9.1 Where it is used
Today AI is involved at these points, and nowhere else:
- Identity verification: reading the document and comparing it with the selfie.
- Driver's licence verification: reading its details and its validity.
- Reading the insurance policy: extracting insurer, number, cover, plate, insured party and validity from the PDF.
- Analysis of inspection photos: detecting damage between handover and return.
- Price suggestions for hosts and vehicle recommendations for travelers.
- Support assistant and translation of Platform content into the languages we offer.
9.2 AI documents; people decide
No dispute is resolved automatically. AI analysis serves to document and to flag what is worth looking at, but the decision on damage, a refund or a suspension is taken by the Vribe team reviewing the file. The same goes for verifications: if the model cannot confirm a document, the case goes to manual review rather than being rejected on its own.
9.3 Your data and model training
Vribe does not train its own models on your data. The models we use to run the service come from external providers, invoked through their business interfaces, whose terms provide that content sent that way is not used to train their models. Advertising is another matter: if you accept that category, Google, Meta and TikTok receive data about your browsing and use it for their own advertising models. A model's outputs are probabilistic: they can be wrong, which is why none of them closes a case on its own.
10. Third-party providers and services
Operating the Platform requires third-party services. Each receives only the data it needs for its function and handles it under its own business terms. We name those you see directly and group the rest by category; the full named list of our processors is available by writing to privacy@vribe.app. The last three are involved only if you accepted the analytics or advertising categories:
- Stripe — payment processing, deposit holds and refunds. Your full card details go to Stripe, not to Vribe.
- Infrastructure providers — hosting and delivery of the Platform, database, authentication, storage of the files you upload, maps, limits against automated abuse and delivery of push notifications. They process your IP address — the country that decides your consent regime is inferred from it — and maps also receive the coordinates of the area being shown.
- Artificial intelligence providers — identity and licence verification, reading of the insurance policy, analysis of inspection photos, price suggestions and recommendations, support assistant and translation of the Platform. It is the same list of uses as in the artificial intelligence section.
- Transactional email — delivery of the emails and notices for your bookings.
- Error monitoring — recording of technical failures so they can be detected and fixed.
- Google — Analytics to measure usage, and Google Ads to measure campaigns and show ads.
- Meta — pixel to measure campaigns and show ads on Facebook and Instagram.
- TikTok — pixel to measure campaigns and show ads on their platform.
Block II — If you rent a vehicle
Binds the person booking. Hosts are not subject to these sections.
11. How booking works
Booking on Vribe has four moments: you search, you choose, it is confirmed and it is charged. Each is worth understanding, because nearly every question about money comes from one of them.
11.1 Search and availability
Each vehicle's calendar is managed by its host, as are the hours at which they can hand it over and take it back. A vehicle appearing in results does not mean it is available on any date or at any hour: real availability is validated at booking time against the calendar and the vehicle's handover hours.
11.2 Instant booking and booking by approval
Each host decides how they accept bookings. With instant booking, your request is confirmed immediately. With booking by approval, the request stays pending and the host has 24 hours to accept it; if they do not respond within that window, the request lapses and you are charged nothing.
11.3 The price you see
You pay the rental plus the delivery fee if you asked for the vehicle to be brought to you. Vribe's commission is not added on top of the host's price: it is deducted from what the host receives. On vehicles rented without placing a hold on your card, the rental price already includes the no-hold fee. The price you see when booking is the final price. The security deposit, when the vehicle requires one, is separate and is not a charge: it is a hold that is released when the trip closes.
11.4 When you are charged
With instant booking the payment is processed on confirmation. With booking by approval the amount is authorized on your card but not charged: it is captured only when the host accepts. If they decline or let the 24 hours lapse, the authorization is released. In both cases the deposit travels as a separate hold.
12. Traveler obligations
The Traveler agrees to use the vehicle only for legal purposes, return the vehicle in the condition in which it was received (per the inspection report), respect the agreed mileage limits, and not sublet the vehicle to third parties.
- Drive with a valid licence and comply with the traffic laws of the country of operation.
- Complete both the handover and the return photo inspection. They are the evidence that later settles any damage dispute.
- Return the vehicle on the agreed date, time and place, with the same fuel level you received it with.
- Take responsibility for fines, infringements and tolls generated during your trip, even if they arrive later.
- Notify the host and Vribe immediately in the event of an accident, theft or mechanical failure.
- Answer for damage you cause that the policy does not cover, up to the deposit and beyond it if the damage exceeds it.
13. Use of the vehicle and authorized drivers
The vehicle is handed to you for the ordinary use you agreed with its owner. The specific limits are set by the rental contract you accept before each trip; what follows carries the heaviest consequences.
13.1 Additional drivers
You may add up to three additional drivers, at no cost. Each needs their own Vribe account with verified identity and licence and no active suspension, and must accept the invitation before the trip starts — that is how they are named in the signed contract. Anyone driving without appearing there is not authorized, and the consequences of an incident under those conditions fall on you.
13.2 What may not be done with the vehicle
The contract lists the prohibitions in full. These are the weightiest, and breaching any of them terminates the rental contract and strips you of the liability limitations that favour you:
- Taking it out of the country without the host's prior, express, written authorization granted through the Platform.
- Driving it without a valid licence, or under the influence of alcohol, medication or drugs.
- Subletting it or handing it to anyone who is not an authorized driver.
- Using it for paid transport of people or goods — taxi, ride-hailing apps, courier work — unless the host expressly authorizes it.
- Towing, racing, overloading it, or employing it in any act contrary to law.
14. Security deposit and damage
The deposit answers for damage, fines and missing fuel. It is not charged at booking: it is held, and released when the trip closes without a claim. If there is a claim, what is deducted comes from comparing the handover inspection with the return inspection, not from either party's word. The full mechanics — amounts, release windows and order of application — are in the deposits document. On No-Deposit vehicles the guarantee is different: your payment method is stored under the authorisation you accept when booking, and it can be charged for verified damage up to the cap disclosed at that moment, only once the collection process has been exhausted without payment. Those mechanics are in the Payment Terms.
15. Cancellations, date changes and extensions
Each vehicle carries the cancellation policy its host chose, and you see it before you pay. If instead of cancelling you want to move the trip, you can request a date change; if the new trip costs more you pay the difference, and if it costs less you are refunded. Once on the trip you can request an extension, which the host approves or declines and which is paid separately. What applies in each case is in the cancellation policy.
16. Traveler's assumption of risk
Driving and renting vehicles involves risk: accidents, theft, damage, mechanical failure and the conditions of traffic and roads. By using Vribe you knowingly assume those risks. Vribe does not physically inspect vehicles or supervise trips: it verifies documents and records the vehicle's condition with photographs at the start and end of each booking. The decision to book a particular vehicle, with a particular host, is yours. That risk does not shift to Vribe merely because the booking was made through the Platform.
Block III — If you list a vehicle
Binds the person listing. Those who only rent are not subject to these sections.
17. Listing a vehicle
Listing means offering your vehicle to strangers who will drive it. That is why the listing has to describe it as it actually is, and its calendar has to reflect when you can genuinely hand it over.
17.1 Accuracy of the listing
Photos must be of the actual vehicle you will hand over, current and without retouching that hides damage. The make, model, year, transmission, capacity and listed features must match what the traveler will receive. A vehicle materially different from its listing is grounds for a dispute and may end in a refund to the traveler.
17.2 Calendar and handover hours
You manage the vehicle's calendar and the time window in which you can hand it over and take it back on each day of the week. The Platform only allows booking within what you enabled. Keeping the calendar current is your responsibility: blocking the dates when the vehicle is unavailable avoids cancellations that cost you later.
18. Host obligations
The Host guarantees that the vehicle is in optimal mechanical condition, has valid vehicle insurance under Guatemalan law, and that they have the legal right to rent it out. The Host is responsible for paying the corresponding taxes on their income.
- Be the vehicle's owner or be entitled to rent it out, and be able to evidence that.
- Keep a valid, verified insurance policy in force while the vehicle is listed.
- Keep the vehicle mechanically safe and current with its servicing and registration documents.
- Hand it over clean, with the agreed fuel level, at the agreed place and time.
- Complete both the handover and the return photo inspection.
- Respond to requests within 24 hours and honour the bookings you have already confirmed.
19. Valid insurance policy
The vehicle's cover is yours and you arrange it with the insurer you choose. Vribe does not insure anyone and is not an insurance agent: what it does is verify your policy and use it as the condition for your vehicle to be bookable.
19.1 No verified policy, no bookings
You upload the policy as a PDF and the Platform extracts and cross-checks its details — insurer, number, cover amount, plate, insured name and validity. Until the policy reaches verified status, your vehicle accepts no bookings at all. This is not a warning or a recommendation: it is a block, and the same check applies when someone requests a date change or an extension.
19.2 No booking may run past the policy's validity
The Platform rejects any booking ending after your policy's expiry date, even if those dates are free on your calendar. If you renew, upload the new policy: until it is verified, your bookable window reaches only as far as the previous policy's expiry. Policy history is retained for one year for oversight purposes.
20. Price, commission and payout
You set the daily rate and the delivery fee. From that total the Platform deducts its service commission, whose percentage drops based on the trips you completed in the previous calendar month, and the rest is paid out to you once the trip closes. If your vehicle is rented without placing a hold on the traveler's card, the price they see also includes the no-hold fee: they pay it, Vribe collects it, and it is not deducted from your payout nor does it change what you receive. The current percentages and the calculation, with examples, are in the fees document.
21. Taxes
Each party is responsible for its own tax obligations. Vribe does not withhold, report or remit taxes on behalf of hosts or travelers, nor does it issue tax documents in their name. Income a host earns by renting out their vehicle may be taxable in their jurisdiction; consult your advisor. Vribe's commission is deducted from the host's payout and is detailed in the Fees Policy.
22. Host tracking devices
Some vehicles published on Vribe carry tracking devices (GPS) installed by their host. Those devices belong to the host, not to Vribe: Vribe does not install them, does not operate them and does not receive the location they record. The host is responsible for using them in accordance with applicable law and for the sole purpose of protecting their vehicle. If this matters to you, ask the host before booking.
23. Host cancellations
Cancelling a confirmed booking is what harms a traveler most, because it usually leaves them without a vehicle on the eve of the trip. If you cancel before handover, the rental and the deposit are refunded to them in full, and any promotional credit they had applied returns to their balance. The cancellation is also recorded in your history and affects your Trust Level. Holding dates you cannot honour is not a strategy: it is the fastest route to suspension.
24. Host's assumption of risk
Handing your vehicle to a third party carries risks Vribe does not remove: damage, wear, fines, misuse, late return and, at worst, theft. The Platform verifies documents, seals the inspections, holds a deposit and offers a dispute process — but it does not drive the vehicle, does not watch over it and does not guarantee the traveler's conduct. The decision to list, and to accept a particular traveler, is yours.
Block IV — General provisions
Applies to everyone and closes the contract: money, content, termination, liability and governing law.
25. Payments and commissions
Vribe charges a variable commission based on the Host's monthly volume (between 18.5% and 13.5% of the booking price), automatically deducted from the Host's payout. All prices and payments are handled in US dollars (USD) and processed via Stripe. The price the Traveler pays is all-inclusive; the vehicle insurance is the Host's responsibility and included in their rate. Cash, direct bank transfers or other unauthorized payment methods are never accepted.
26. Damages and disputes
Vribe's AI inspection system documents the vehicle's condition at the start and end of each booking. If new damage is detected, the Vribe team aims to review the case within 72 hours of the dispute being opened. Vribe's decision closes the case within the platform; if you disagree, the route set out in the dispute resolution clause remains open. The full process is in the Disputes and Incidents Policy.
27. Incidents, unreturned vehicles and theft
If the vehicle is involved in an accident or incident, is not returned or is stolen, both parties must report it immediately through the platform. The host can open a theft report from their dashboard: doing so moves the booking into dispute and suspends the accounts of the traveler and of any authorized additional drivers while the case is investigated. Vribe assembles the case file from evidence that already exists — pickup and return inspections, the signed contract and the booking conversation. The traveler's identity documents are released to the host only on a case-by-case basis, when Vribe authorizes it in order to file a report with the authorities, in accordance with the Privacy Policy. If the dispute is resolved in the traveler's favor, the suspensions are lifted.
28. Disruptive events and force majeure
If an event beyond the parties' control prevents the trip — natural disaster, road blockade, order of authority or severe disruption of services — the cancellation policy tiers do not apply. If the event occurs BEFORE the vehicle is handed over, Vribe refunds 100% of what it processed for the booking, including the deposit. If it occurs once the trip has started, Vribe assesses each case with the available evidence: we do not commit to a fixed percentage because the days already used and the costs borne by the host vary in each situation. Vribe determines whether an event qualifies as disruptive.
29. Reviews
Reviews are double-blind: neither party sees the other's until both have reviewed, or until 14 days have passed since the first one. They must be honest, your own, and about the actual trip experience. Conditioning a review is prohibited — offering something in exchange for a rating or threatening a negative one — as is publishing third parties' personal data or using reviews to extort. Vribe may remove a review that breaks these rules; it does not remove one for disagreeing with the opinion, nor at the request of the person reviewed.
30. Vribe's intellectual property
The Vribe name and logo, the Platform's design, its source code, its interface, its texts and all material Vribe produces are its property and are protected. Using the Platform transfers no rights over them to you: you may not copy, modify or redistribute them, or register trademarks or domain names that resemble them or are likely to cause confusion. This does not reach what you publish, which remains yours under the section on published content.
31. License over published content
The host warrants that the photos, descriptions and other content they publish are their own or that they have permission to use them, and that they correspond to the actual vehicle offered. By publishing them, the host grants Vribe a non-exclusive, royalty-free and revocable license to display them on the platform and in materials promoting the listing. The license ends when the content is removed, except for copies already incorporated into a booking's case file or into already-published materials. Vribe may remove content that is false, not the host's own, or that infringes third-party rights.
32. User content and copyright policy (DMCA)
Users may upload content (photos, documents). We respect intellectual property rights. If you believe content on the platform infringes your copyright, send a notice to our Designated Agent including: (1) your signature; (2) identification of the copyrighted work; (3) identification of the infringing material and its location; (4) your contact information; (5) a statement of good-faith belief that the use is unauthorized; and (6) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act. Designated Agent: legal@vribe.app. We will promptly remove infringing material upon a valid notice and may terminate the accounts of repeat infringers.
33. Prohibited uses and sanctions compliance
You may not use Vribe for any unlawful purpose or in any way that violates applicable law. Vribe, Inc. is a U.S. company and must comply with U.S. economic sanctions laws. You may not use the platform if you are located in a country or territory subject to comprehensive U.S. sanctions (including Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk and Luhansk regions of Ukraine), or if you are listed on a sanctions list. We may suspend or terminate accounts to comply with these obligations.
- Breaking the law using the Platform or a vehicle booked through it: illegal transport of people or goods, smuggling, money laundering, or any dealing with persons or countries subject to international sanctions.
- Misrepresenting information: using someone else's or altered documents, claiming an identity that is not yours, opening multiple accounts, or describing a vehicle in a way that does not match what you will hand over.
- Failing to honour what you committed to: not honouring a confirmed booking, not showing up for handover, not returning the vehicle within the agreed window, or refusing to complete the inspections.
- Harming or threatening other users: harassment, intimidation, violence, discrimination on any ground, or publishing their personal data.
- Taking the transaction off the Platform: agreeing payments outside it, asking for or accepting money through another channel, or using the chat to move the deal elsewhere and avoid the commission. Off-Platform there is no deposit, no sealed inspections and no dispute process.
- Manipulating the trust mechanisms: fake or purchased reviews, self-invitations, coordinated accounts, or simulated bookings to inflate history or trigger rewards.
- Interfering with the operation of the service: automated data extraction, reverse engineering, deliberate overloading, or circumventing security, verification or payment controls.
34. Account suspension and termination
You can stop using Vribe whenever you want. To close your account, write to us: there is currently no self-service button to do it, and the request is handled under the rights and timeframes of the Privacy Policy. Vribe may suspend or close an account when these Terms are breached, when there is a theft report or a serious incident under investigation, when identity or license verification fails or expires, or when required by law. A suspended account cannot create new bookings and only a Vribe administrator can reactivate it. Bookings already confirmed are resolved according to their own status and the applicable cancellation policy. Pending payment obligations, open disputes and the clauses that by their nature must survive — including limitation of liability, indemnity and dispute resolution — survive termination.
34.1 What survives termination
Closing your account does not erase what remained outstanding. Payment obligations already accrued remain in force, as do liability for damage caused during a trip, open disputes, the licence over content you published, the limitation of liability and indemnification clauses, and those on governing law and jurisdiction. Records that the law or the evidence of an open case require us to keep are also retained, as set out in the privacy policy.
35. Electronic communications
By creating your account you agree to receive, by email and push notification, the communications needed to operate the service: booking confirmations, pickup and return notices, reminders, verification results and notices about disputes or payments. Those communications are part of the service and are not switched off while you have active bookings. Marketing communications are optional: they are off by default and you turn them on or off in your preferences.
36. Notices
Notices Vribe sends you are given to the email address registered on your account, or through a notice within the Platform; they are deemed received on the day they are sent. Keeping that email current and accessible is your responsibility. Notices you send us are given to legal@vribe.app. Notices between host and traveler about a booking are given through the Platform chat, which is recorded.
37. Service availability and warranties
The Platform is offered as is and as available. We do not commit to guaranteed uptime or a service level: there may be maintenance, outages, errors, and features that change or are withdrawn. Nor do we guarantee that you will find a vehicle, that a host will accept your request, that information published by other users is accurate, or that the Platform will meet a particular purpose. We make reasonable efforts to keep it available and secure, and that is what we promise.
38. Limitation of liability
This is the section most worth reading in full. Vribe operates the Platform; it does not drive the vehicles, does not hand them over or take them back, and is not present during the trip. Its liability is therefore limited to what it does control — that the Platform works, that payments are processed and that the dispute process is followed. What happens to the vehicle and to people during the rental is a matter for the parties to that contract and, where applicable, for the host's policy.
38.1 Injury, bodily harm and death
Vribe is not liable for injury, bodily harm or death of the traveler, additional drivers, passengers or third parties, occurring during the trip or in connection with it. Nor for medical expenses, disability, loss of earnings or non-pecuniary damage arising from an accident. Those risks belong to the vehicle's policy, to each person's own insurance and to the liability of whoever caused the event.
38.2 Damage to the vehicle, total theft and partial theft
Vribe is not liable for damage to the vehicle, collision, rollover, fire, vandalism, or its total theft. Nor for partial theft: removal of tyres, battery, mirrors, stereo, catalytic converter, accessories or any part or component. Those events are settled between the parties through the host's policy, the security deposit and the dispute process the Platform runs.
38.3 Personal belongings and cargo
Vribe is not liable for loss, theft, damage or deterioration of personal belongings, luggage, documents, money, electronic equipment or cargo left or carried inside the vehicle, whether before, during or after the trip. That includes what the host leaves in the vehicle on handover and what the traveler forgets on return.
38.4 Acts of nature and acts of third parties
Vribe is not liable for damage caused by earthquake, eruption, flood, landslide, hurricane, hail, lightning storm, wildfire or any other act of nature, whether occurring before, during or after the trip. Nor for road blockades, civil unrest, acts of authority, robbery with violence or acts of third parties outside the Platform. The disruptive-events section governs what happens to the booking's money in those cases; this one governs who bears the damage, and it is not Vribe.
38.5 Indirect damages
In no event is Vribe liable for indirect, incidental, special, punitive or consequential damages, nor for loss of profit, loss of opportunity, loss of data, loss of reputation or alternative travel costs, even if it had been advised of their possibility.
38.6 Liability cap
Where, despite the above, some liability is attributable to Vribe, its total aggregate amount will not exceed what you paid through the Platform for the booking that gave rise to the claim. If the claim is not tied to a specific booking, the cap is what you paid in the twelve months preceding the event.
38.7 What is not excluded
Nothing in this section limits Vribe's liability for its own wilful misconduct or gross negligence, nor excludes rights that applicable law grants consumers on a non-waivable basis. If a jurisdiction does not allow one of these exclusions or limitations, that part is reduced to the minimum the law permits and the rest of the section remains in force. 39. Indemnity
You agree to hold Vribe, Inc. and its team harmless from claims, damages and reasonable expenses — including legal fees — arising from your breach of these Terms or of the rental agreement, your use of the vehicle or of the platform, the content you publish, or your violation of the law or of third-party rights. This obligation does not extend to anything resulting from Vribe's own negligence.
40. Dispute resolution
If the dispute concerns a booking, the Vribe dispute process must be exhausted first: it is opened from “My trips” with supporting evidence, and Vribe aims to resolve it within 72 hours of it being opened. Once that process is exhausted — or if the dispute does not concern a booking — it is submitted to the competent judicial body. Nothing set out here deprives you of the mandatory consumer protection rules of your country of residence.
41. Jurisdiction
Vribe is operated by Vribe, Inc., a company incorporated in Delaware, USA. These Terms are governed by the laws of the State of Delaware, USA, without giving effect to its conflict-of-laws rules. The foregoing does not deprive you of the protection of the mandatory consumer rules of your country of residence. For the rental service provided in Guatemala, the local rules in the Guatemala supplement of the Legal Center also apply.
42. Changes
Vribe may modify these terms. When the change is substantial — a new obligation for you, a modification of the price or of the cancellation conditions, or a new provider receiving your data — we give you 30 days' notice before it takes effect. Editorial corrections and adjustments that do not alter your rights or obligations take effect on publication; the last-updated date always appears above, so you can see when the version you are reading changed. Continued use of the platform after a change takes effect constitutes acceptance of the new terms.
43. Final provisions
The usual contractual closers, governing how everything above is read and applied.
43.1 Interpretation
Section headings are for reference and do not limit their content. "Includes" and "such as" are to be read as non-exhaustive. These Terms, together with the documents they incorporate by reference, constitute the entire agreement between you and Vribe regarding use of the Platform, and supersede any prior understanding on the same subject.
43.2 No waiver
Vribe not exercising a right or not enforcing a clause on one occasion does not mean it waives doing so later. Any waiver must be in writing to be valid, and applies only to the specific instance in which it was granted.
43.3 Assignment
You may not assign or transfer your account, or the rights and obligations arising from these Terms, without our prior written consent. Vribe may assign them to an affiliate or in the context of a merger, reorganization or sale of assets, provided your rights are not diminished.
43.4 Severability
If a court of competent jurisdiction holds any provision invalid or unenforceable, that provision is limited or severed to the minimum extent necessary, and the remainder of these Terms remains in full force.
43.5 Who you are contracting with
Your counterparty under these Terms is Vribe, Inc., a company incorporated in the State of Delaware, United States, which operates the Platform. It is the only entity bound by this document; neither its affiliates nor its providers assume obligations towards you under this contract.

What Vribe is NOT
Vribe is not a car rental company, an insurer, an insurance agent or a bank. It does not own the listed vehicles, does not drive them, does not hand them over and does not inspect them in person. It is not a party to the rental contract between host and traveler, nor the employer, partner or representative of either.
In the event of any discrepancy between the translated versions of this document, the Spanish version prevails.
