# Rental with Chauffeur Conditions Last updated: 10/09/2026 These conditions govern the service Vribe calls "Rental with Chauffeur". They add to the Terms of Service and to your country's supplement; on what they regulate here they prevail, and on everything else the Terms, Vribe's policies and the law continue to apply. Both parties accept them: the Passenger, when paying for a booking with chauffeur, and the Host, when offering a vehicle in this mode. Vribe keeps an electronic record of each acceptance (clause 18). We address you directly. When a clause is only for the Passenger or only for the Host, it says so at the start. In this mode: - Passenger is the person who books or uses the ride. - Host is the person who offers the service on Vribe. - Chauffeur is the person who drives the vehicle during the service. It may be the Host or a person the Host designates who meets the requirements. - Platform is Vribe's technology and digital services. 1. What you are booking For the Passenger. You are booking a ride: the Host provides the vehicle and a Chauffeur for the period and from the meeting point stated in your booking. You do not receive possession, tenancy, custody or control of the vehicle; you do not rent it, you do not drive it and you may not let anyone else drive it. It is an individual service, agreed in advance between you and the Host. It is not collective transport, a public route, a taxi, or any other administrative category other than the one that may apply by law. The service is provided within Guatemala. 2. What Vribe does Vribe is the platform: it publishes the services, makes searching and requesting possible, manages the booking, connects you with the other party, collects the price on the Host's behalf under the Payment Terms, records the booking's events, verifies identity and documents under its policies, and handles disputes and incidents. Vribe does not provide the vehicle, does not drive it, does not designate the Chauffeur, does not take part in hiring or paying the Chauffeur, and does not decide how the ride is carried out. The Chauffeur is the Host or someone the Host designates; the Host organizes the service and, where applicable, chooses, assigns and pays the Chauffeur. None of this excludes what Vribe expressly undertakes towards you or any liability the law does not allow to be excluded or limited. 3. Host's responsibility and obligations For the Host. You are responsible for the service you offer being lawful to provide and for the vehicle and the Chauffeur complying with the law that applies to them. To that end: a) you own the vehicle, hold it lawfully, or have sufficient authorization to use it for the service; b) you keep its documentation current; c) you keep it in reasonable conditions of safety and working order; d) if you drive, you meet the legal requirements for the Chauffeur and for the service; e) if you designate someone else, you make sure that person meets the requirements to drive and to provide the service; f) you meet the obligations the law imposes on you regarding the Chauffeur when that is another person; g) you keep the insurance the law requires and the insurance you declared when publishing; h) you notify Vribe of any change that affects the legality, safety or availability of the service; and i) you comply with the laws, regulations and administrative rules of your activity. If you drive, you take on the Chauffeur's obligations directly without ceasing to have the Host's. If you designate a third party, you remain liable to the Passenger as the provider of the service, without prejudice to what the law attributes directly to the Chauffeur. Publishing on Vribe does not certify that you comply with the law. When Vribe verifies something, that verification has the scope described in "Verification and Trust Score" and does not replace your legal obligations. 4. The Chauffeur The Chauffeur is the Host or a person the Host designates. If the Host drives, the Chauffeur's obligations are directly the Host's. If the Host designates someone else, that person must meet the legal requirements throughout the service, and it is the Host who verifies that they do. Vribe may verify the Chauffeur's data —identity and driving documents— under its verification processes. That verification does not guarantee that the Chauffeur meets every legal, labour, tax, administrative or professional obligation that applies. 5. Insurance For the Host. You keep the insurance the law requires and inform Vribe accurately about any relevant condition of the coverage. If you use the vehicle for anything other than its ordinary private use, you make sure your policy allows it and covers the circumstances of the service. Vribe is not an insurer and does not issue policies in this mode. Whether or not a policy exists, and whatever its limit or scope, does not remove the legal obligations of either party. 6. Price and payment For the Passenger. Before paying you see the price and what it includes. The breakdown shows separately, where applicable: the vehicle rate, the Chauffeur rate, the extras you chose and any other charge paid through the Platform that was disclosed to you beforehand. The total you see is what you pay for the booking through Vribe, except for later charges you expressly authorize under these conditions or that are due by law. In this mode you pay no fee to Vribe. Vribe's commission is paid by the Host: it is calculated on the booking total —Chauffeur rate and extras included— and deducted from the Host's payout, as described in "Fees and Commissions". Vribe collects the price on the Host's behalf, under the Payment Terms. If the Chauffeur is a person other than the Host, paying the Chauffeur is the Host's responsibility. 7. Fuel, meals, lodging and other expenses Unless the listing expressly says otherwise, the Chauffeur rate covers only the driving during the contracted working day. The vehicle's fuel, the Chauffeur's meals and lodging during the service, tolls and parking are not in the booking price. You pay them directly, when they arise, at their actual cost. Vribe does not collect them and does not set their amount. Vribe tells you this before you pay: in the vehicle listing and in the checkout. No other expense may be presented to you as mandatory if it was not disclosed beforehand or is not due by law. Tips to the Chauffeur are voluntary and are not part of the price. 8. No security deposit Since you do not receive possession or control of the vehicle, this mode requires no security deposit and does not store a payment method as a guarantee. That does not release you from damage directly attributable to you under these conditions and the law. 9. Confirmation, start and end Every booking with chauffeur goes through the Host's confirmation, even if the vehicle allows instant booking in other modes. When you request it: a) you authorize the amount on your payment method; b) the charge is made when the Host confirms; and c) if the Host does not accept within the period stated in the Bookings Policy, the authorization is released without charge. The service starts when you board the vehicle and validate on the Platform the start code the Chauffeur gives you. That validation is the electronic record of the start. Vribe keeps a record of your acceptance of these conditions: the version, the language, the date and time, and the technical data needed to evidence it. The service ends at the date and time of your booking, unless a change is accepted under these conditions. The Host records the close on the Platform; if the Host does not, Vribe records it 24 hours after the end time. That close is an administrative record and does not by itself change the rights and obligations arising from the service actually provided. 10. If the service does not start If the start time arrives and there is no confirmation of start, Vribe asks both parties for confirmation through the Platform. From that moment, the Passenger can report that the Chauffeur did not show up, and the Host or the Chauffeur, that the Passenger did not show up. If two hours pass from the start time without confirmation, Vribe marks the booking as not started and asks the parties for information. If the service did not start because of the Host or the Chauffeur —they did not show up, no Chauffeur was assigned, the vehicle could not provide the service—, the Passenger is entitled to a refund of everything paid for the service not provided, under the "Cancellation and Refund Policy", unless the law provides otherwise. If it did not start because of the Passenger, the cancellation or no-show conditions shown at booking apply. If the cause cannot reasonably be determined, Vribe reviews the records and the parties' statements under the "Disputes and Incidents Policy". 11. Working day and extra time The working day included is the one stated in the listing and shown to you before paying. You can request extra time from the Platform, within the limits it indicates. The request shows the hourly price; by sending it, you accept that price and authorize on your payment method the amount for the hours you requested. The Host may decline: in that case there is no charge and the authorization is released. Extra time is charged at the close of the service only for the hours you used, never beyond the hours you requested and accepted. Staying in the vehicle after the working day does not by itself authorize any additional charge. If the extension was caused by the Host or the Chauffeur, you can contest the charge under the "Disputes and Incidents Policy". 12. Passenger and companions For the Passenger. As the booking holder, you give truthful information about who will use the service when asked. If you are not travelling yourself, you indicate in the booking chat the person or people who will; chat messages are recorded (clause 17). The start code is validated, in any case, by your account. You and your companions: a) respect the law and applicable rules; b) follow the Chauffeur's reasonable safety instructions; c) respect the vehicle's maximum capacity; d) use seat belts and safety systems when required; e) avoid conduct that endangers people, the vehicle or third parties; and f) give correct and complete information when needed to provide the service. 13. Minors If minors travel, you comply with the law on their transport. If you booked a child seat or restraint system as an extra of the vehicle, the Chauffeur installs it; its correct use during the service is the responsibility of the adults accompanying the minor. The vehicle's extras are governed by the Vribe policies that apply to them. 14. Conduct and damage For the Passenger. You and your companions are liable only for direct damage to the vehicle or its accessories reasonably attributable to what you did or failed to do. The following is not attributed to you merely because it happened during the trip: a) normal wear; b) a mechanical failure; c) a pre-existing defect; d) an accident or incident attributable to the Chauffeur; e) an act of a third party; or f) an unavoidable circumstance or one beyond your reasonable control. Traffic fines and penalties arising from driving during the service belong to the Chauffeur or the Host, as the law provides. Only those directly caused by your conduct or your companions' can be attributed to you. Any damage claim is supported, to the extent reasonably available, with photographs, videos, electronic records, reports, testimony, documents or other evidence. The Chauffeur's report is information, not conclusive proof of your liability. Claims are handled under the "Disputes and Incidents Policy", without prejudice to the rights the law grants you. 15. Suspension or termination for safety The Chauffeur may suspend or end the service for an objective and reasonable cause: a) a risk to people's safety or integrity; b) a serious risk to the vehicle; c) conduct that prevents the service from being provided safely; or d) an unlawful activity, completed or attempted. When possible, the Chauffeur explains the reason to you and records the incident on the Platform as soon as possible. Ending the service for safety does not by itself generate an additional charge and does not decide who bears the cost of the incident. 16. Cancellations and changes Your booking is governed by the "Cancellation and Refund Policy", which you can read before paying. Its percentages apply to the booking total, Chauffeur rate and extras included. Any substantial change to the booking is disclosed and, where applicable, accepted through the Platform before it takes effect. 17. Chauffeur's data and communication So that you can identify the Chauffeur, Vribe may show you what is reasonably necessary: their name, photo and trust indicators. It does not show you their documents, ID number, licence number or personal phone, except for a legitimate reason, a legal obligation or an authorization. Communication about the booking goes, preferably, through Vribe's tools. What is communicated through the Platform is kept as a record of the booking and may be used as evidence in support, disputes or legal compliance. 18. Electronic records and evidence The parties acknowledge that the records the Platform generates can be evidence of what happened on it, among others: a) the acceptance of these conditions by the Passenger and by the Host; b) requests and confirmations; c) messages; d) code validation; e) start and close date and time; f) changes; g) payment authorizations; h) incident reports; and i) information provided in a dispute. The existence of a record does not prevent submitting further evidence and does not by itself decide a controversy. 19. Verification and account suspension Vribe may ask you for information or documents reasonably necessary to verify identity, safety, compliance with the Platform's rules or the requirements of a booking. Vribe may reject, suspend, limit or remove a listing, a booking or an account for reasonable grounds of safety, fraud, false information, breach of these conditions or of Vribe's policies, or at the request of a competent authority. It may do so preventively when reasonably necessary to protect users, the Platform or third parties. 20. Relationship between the parties Using Vribe does not by itself create an employment relationship between Vribe and the Chauffeur, nor make Vribe the owner, lessee, operator or holder of the vehicle. The relationship between the Host and the Passenger is defined by the actual nature of the service, by these conditions and by the law. Nothing here seeks to exclude a legal relationship the law determines exists, whatever it is called. 21. Vribe's liability Vribe is liable for the obligations the law imposes on it as provider of the Platform and for those it expressly undertakes towards you. To the fullest extent the law allows, Vribe is not liable for facts that depend directly on the Host, the Chauffeur, the Passenger or third parties: the driving of the vehicle, mechanical conditions Vribe did not know of, acts of the Chauffeur, loss of belongings, traffic delays, decisions of third parties or circumstances beyond its reasonable control. Vribe does not guarantee: a) that a published service is always available; b) that a Host or a Chauffeur will act in a particular way; c) that a vehicle remains available; d) that no accidents or incidents occur; or e) that another user's information is always accurate or complete. Nothing in this clause limits liability the law does not allow to be excluded or limited. 22. Host's indemnity For the Host. To the fullest extent the law allows, you hold Vribe harmless from third-party claims arising directly from: a) the material provision of the service; b) the driving of the vehicle; c) acts or omissions of the Chauffeur; d) your legal breaches; e) lack or insufficiency of documents or insurance you were required to keep; f) labour, tax or administrative breaches regarding the Chauffeur; or g) false or misleading information you provided. This does not apply to the extent the claim arises from Vribe's own conduct that gives rise to liability for Vribe by law. 23. Force majeure No party is liable for breaches directly caused by circumstances it could not reasonably control or avoid: natural disasters, road closures, acts of authority, unrest, widespread infrastructure failures, interruptions of third-party technology services or other extraordinary events. This does not remove refund rights or consumer protection the law grants you. 24. Governing law and disputes These conditions are governed by the laws of Guatemala when the booking and the service are subject to Guatemalan law, without prejudice to mandatory rules that apply because of your domicile as a consumer, the place of the service, the location of the vehicle or any other relevant circumstance. Before going to court, the parties try to use Vribe's support and disputes process, unless the law allows or requires going directly to an authority or court. Nothing here limits your non-waivable rights as a consumer, prevents you from filing a claim with a competent authority, seeks to bar your access to the courts where the law allows it, or is a waiver of rights the law does not allow to be waived. If the law of a United States jurisdiction applies, its mandatory provisions prevail over any incompatible provision of these conditions. 25. Language These conditions are written in Spanish. Vribe shows and stores them in the language in which each party accepted them, identified by version; accepting them in any of the Platform's languages counts as acceptance of that version. If a translation and the Spanish text of the same version differ, the Spanish version prevails to the extent the law allows. 26. Severability If a competent authority declares a provision invalid, unlawful or unenforceable, that provision is interpreted or modified to the minimum extent needed for it to be valid and enforceable. The rest remain in force. 27. No waiver Vribe not immediately exercising a right or power under these conditions does not mean it waives it. Where the law so requires, any waiver must be express. 28. Changes Vribe may change these conditions when required by changes in the Platform, its services, its policies or the law. Each version is identified by an identifier and its date. Substantial changes are communicated through the reasonable means available and do not retroactively affect a booking already confirmed where that would be contrary to the law. A new version is presented to the Host for acceptance before offering or accepting new bookings with chauffeur, and to the Passenger when paying for each booking. By paying for a booking with chauffeur, the Passenger declares having had access to these conditions and accepts the version in force for that booking. By offering a vehicle in this mode, the Host declares the same regarding the version in force at that time.
